Can debts owed to Canada Revenue Agency be included in a Bankruptcy filing?

All unsecured amounts owed to Canada Revenue Agency up to the date prior to your Bankruptcy will be included.

However, you will be required to file any outstanding taxes in order for Canada Revenue Agency to determine the total debt owed, so that they can submit a claim on that amount.

For any debt owed to the Canada Revenue Agency from the date of bankruptcy onwards, you are responsible to pay as this is considered post-bankruptcy debt.

If the Canada Revenue Agency has put a Writ on your home prior to filing a Bankruptcy, this effectively makes them a secured creditor, similar to a mortgage, and this amount cannot be included in the Bankruptcy unless the property is surrendered.
